Welcome to LA SmartCan Services. These Terms and Conditions (“Terms”) form a legally binding agreement between you (“Customer,” “You”) and LA SmartCan Services (“We,” “Us,” or “Our”). By accessing our website, scheduling services, or subscribing to a plan, you agree to comply with these Terms.

1. Service Description

LA SmartCan Services provides curbside bin placement and retrieval for residential properties. Optional SMS reminders are available upon request. Service includes up to 3 bins per visit unless otherwise arranged.


2. Customer Responsibilities

To ensure successful service, you agree to:

  • Keep bins visible and accessible
  • Provide gate codes or access if needed
  • Secure pets during service times
  • Keep account and contact information up to date

Failure to meet these requirements may result in skipped service without refund.


3. Scheduling & Service Availability

Services are performed on scheduled collection days. Exact service times are not guaranteed and may vary due to weather, holidays, or operational needs.

We reserve the right to delay, reschedule, or skip service due to:

  • Unsafe conditions
  • Inaccessible properties
  • Weather or emergencies
  • Policy violations

4. Subscription & Billing

By enrolling in a service plan, you agree to recurring billing.

  • Payments are charged automatically based on your selected plan (e.g., monthly)
  • Payment must be completed prior to service
  • Failed or declined payments may result in service suspension or cancellation

We use secure third-party payment processors (such as Stripe) and do not store your full payment details.

5. Cancellation Policy

You may cancel your service at any time by:

  • Accessing your customer billing portal
  • Contacting us by email or phone

To avoid being charged for the next billing cycle, cancellations must be made at least 24 hours before your next billing date.

No refunds are provided for partially used billing periods or completed services.

6. Account Suspension & Termination

We may suspend or terminate service for:

  • Non-payment
  • Unsafe service conditions
  • Abusive or inappropriate behavior
  • Violation of these Terms

7. Right to Refuse Service

We reserve the right to refuse or cancel service at our discretion if a property is unsafe, inaccessible, or in violation of our policies.

8. Limitation of Liability

LA SmartCan Services is not liable for:

  • Missed or delayed services due to uncontrollable conditions
  • Minor or incidental damage resulting from normal service operations
  • Items left in or around bins

Our total liability is limited to the amount paid for the affected service.


9. Indemnification

You agree to indemnify and hold harmless LA SmartCan Services and its team from any claims, damages, or losses resulting from your use of our services or violation of these Terms.

10. Acceptable Use

You agree not to:

  • Use our services for illegal or hazardous waste
  • Provide false or misleading information
  • Harass or threaten our staff

We reserve the right to deny service for violations.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in the appropriate jurisdiction within Los Angeles County.
